The purpose of these terms and conditions of use (hereinafter referred to as the “T&Cs”) is to define the terms and conditions of use of the website “https://fr.renaultclassic.com/” (hereinafter referred to as the “Website”) published by Renault s.a.s, a simplified joint-stock company with capital of €533,941,113, whose registered office is located at 13/15 quai Alphonse Le Gallo – 92100 Boulogne Billancourt cedex, entered in the Nanterre Trade and Companies Register under No. 780 129 987 (hereinafter referred to as “RENAULT”);
For the purposes of these Terms and Conditions of Use:
“Website” shall mean the website “https://fr.renaultclassic.com/” published by RENAULT, giving access to the elements. The Website also includes the Content, software, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements and services constituting it, updates and new versions that may be added to the Website by RENAULT.
“Content" shall mean, without this list being exhaustive, the editorial content, drawings, illustrations, photographs, graphic charters, brands, logos, insignia, trade names, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content present within the Website.
“Elements” shall mean the various features and elements of information offered on the Website.
“User” or “You” shall mean a physical person of legal age navigating on the Website for their own needs, strictly for personal use only and not commercial use, and not for direct or indirect profit.
“Vehicle” shall mean any vehicle of the RENAULT brand.

It is understood that RENAULT reserves the right to modify, at any time and without prior notice, information appearing on the Website, in particular that relating to the technical features and equipment of the models presented.
RENAULT grants the User the non-exclusive, irrevocable, non-assignable, non-transferable, worldwide and free-of-charge personal right to use the Website, the Content and the Elements, solely for their own needs within the framework of the Use of the Website, and for no other purposes.
The User shall not acquire any other right on the Website, Content and/or Elements than those granted hereunder.

The Website is permanently accessible, except in the case of force majeure or the occurrence of an event outside of RENAULT’s control, and subject to possible breakdowns and maintenance required for the proper functioning of the Website.
7.1. To the extent required by the applicable laws and regulations, and within the limits of the present clause of the Terms and Conditions as a whole, RENAULT may assume its responsibility as regards use of the Website and shall demonstrates its commitment in respect of the speed, performance or quality of the Website. In particular, access to the Website may be temporarily and periodically suspended for technical reasons; where appropriate, the technical teams will make their best efforts to resolve the problem at their earliest convenience.
7.2. RENAULT does not guarantee that the Website will be free of any errors or anomalies or that it might not be subject to attacks, particularly by viruses, which may lead to malfunctions, disruptions, breakdowns or losses of data or information.
Finally, it is understood that the Content of the Website shall be presented without any guarantee of any nature whatsoever, which the User expressly acknowledges.
7.3. Access to and use of the Website shall be at the User’s own risk. It is the User’s responsibility to take all appropriate measures to protect their own data and/or software stored on their telephone and computer equipment against any damages.

They acknowledge that RENAULT may not be held responsible for direct or indirect damage, and in particular material damage, immaterial damage, loss of data or programs, financial damage, resulting from access to or use of the Website, or as a result, in particular of the interruption, suspension, modification or discontinuation of the Website or one of its elements.
Use of the Website may require the collection of personal data by RENAULT allowing direct or indirect identification of the User.

The Website is protected in respect of the intellectual and/or industrial property rights.
The photographs, texts, slogans, drawings, images, animated sequences with sound or otherwise, including any works integrated in the Elements of the Website are the property of RENAULT or a third party that has authorised RENAULT to use them.
The reproduction, on paper or on electronic medium, of this Website and the works and Vehicle models that are displayed are allowed provided that they are strictly limited to personal use excluding any use for advertising and/or commercial and/or informational purposes and that it must be compliant with the provisions of Article L122-5 of the Intellectual Property Code.
With the exception of the above provisions, any reproduction, representation, use or modification, by whatever process and in whatever format, of all or part of the Website and of all or part of the different works and vehicle models of which it is composed, without having obtained the prior authorisation of RENAULT, is strictly prohibited and constitutes a counterfeiting offence punished by three years’ imprisonment and a fine of €300,000.
The RENAULT CLASSIC and RENAULT designations, the name of the Vehicle models offered by RENAULT, the slogans and the logos are, unless otherwise specified, trademarks registered by RENAULT or third parties who have authorised RENAULT to use them.
The reproduction, imitation, use or affixing of these trademarks without the prior permission of RENAULT or their respective owners constitutes a counterfeiting offence punished by four years’ imprisonment and a fine of €400,000.
Subject to the provisions of the T&Cs, the User must neither copy, modify, reproduce, in whole or in part, in any format whatsoever, the information and elements that are displayed on the Website, which neither intervene on the elements of this Website, nor act in a manner that contravenes RENAULT’s intellectual property rights and third parties that have authorised RENAULT to use them. The use of an intellectual property right of RENAULT or a third party that has authorised RENAULT to use it, not expressly authorised by the T&Cs is strictly prohibited.
The T&Cs, the Content and all rights and obligations generated within the framework of the use of the Website or relating thereto are governed by French Law and are interpreted and applied in accordance with the latter.
In the event of a dispute relating to the T&Cs and to access and use of the Website, an attempt must be made to reach an amicable settlement between the parties before the dispute is brought before the Courts within the jurisdiction of the Court of Appeal of Paris to which the parties confer exclusive jurisdiction, notwithstanding the plurality of defendants or claims for damages from third parties.
The applicable T&Cs are those in force on the date of the connection and use of the Website by the User.
RENAULT reserves the right to modify and update these T&Cs without prior notice at any time and without informing Users.
Where appropriate, modifications and updates are binding on the User as of their publication on the Website, it being the User’s responsibility to consult the T&Cs in force on each connection.
12.1 No waiver
The fact that one of the parties does not invoke one of the clauses of these T&Cs will not be interpreted as a temporary or definitive waiver of the benefit of the provision in question, which will remain applicable.
12.2. Nullity of a clause
If one or several stipulations of these T&Cs is declared null, void, or unwritten when applying current regulations, a change or following a definitive decision from a competent jurisdiction, the other stipulations will retain all their force and scope, and the parties commit to setting up, as soon as possible, a valid substitute provision with an equivalent scope, which is as close as possible to the spirit of these provisions.
12.3 Force Majeure
The following are expressly considered to be cases of force majeure, in addition to those which are customarily considered as such by the case law of the French courts: adverse weather conditions, legal or governmental restrictions, computer breakdown, interruption of telecommunications, the failure of the RENAULT servers and any other case outside of the express control of RENAULT.
